These Terms and Conditions govern the use of TuGym ("the Service"), an online gym management system provided by infoguille.com ("the Provider"). By registering a gym or using the Service, the account holder ("the User") declares to have read and accepted these terms in full.
The Service allows the User to manage the gym's members, plans, payments, workouts, announcements and statistics, and to offer members read-only access. The Provider may add, modify or discontinue features in order to improve the Service.
The User is responsible for the accuracy of the registration data, the confidentiality of the credentials and all activity carried out from the account and from the staff accounts the User enables. The User shall notify the Provider immediately of any unauthorized use.
The Service offers a free plan with a member limit and paid plans with higher limits, whose prices are published on the site in US dollars per month. The Provider may change prices with prior notice, effective from the following period.
Paid plans are paid in advance per period through the payment methods indicated by the Provider. If the period expires without payment, the account enters a grace period; once it ends, the Provider may suspend access until payment is made. Amounts paid are non-refundable.
The personal data of members that the User uploads to the Service is the User's responsibility, who acts as the data controller under Uruguayan Law No. 18,331 on Personal Data Protection and its regulations. The User declares to have the members' consent for such processing. The Provider acts as data processor: it uses the data solely to provide the Service, does not sell or transfer it to third parties and applies reasonable security measures, including encrypted connections, data separation between gyms and periodic backups.
The User shall use the Service in accordance with the law and these terms. It is forbidden to use it to send unsolicited communications, upload unlawful content, attempt to access other gyms' data or disrupt the system. Breach entitles the Provider to suspend or terminate the account.
The Provider will endeavor to keep the Service continuously available, notwithstanding interruptions due to maintenance, failures of third-party infrastructure providers or force majeure.
The Service is a management tool. Business decisions, collection from members and the gym's obligations are the User's sole responsibility. In no event shall the Provider's liability exceed the amount paid by the User in the three months prior to the event giving rise to it.
The User may request account closure at any time. The Provider may retain information for the period required to comply with legal obligations and will then delete it.
The software, the TuGym brand and the contents of the Service belong to the Provider or its licensors. The User retains ownership of the data it uploads.
The Provider may amend these terms. Changes will be published on this page with their update date; continued use of the Service implies acceptance.
These terms are governed by the laws of the Oriental Republic of Uruguay. Any dispute shall be submitted to the competent courts of the Oriental Republic of Uruguay.
